Terms of Service

These terms govern your use of the Byrd choir management platform (“the Service”), operated by Shaun Brown trading as Byrd (“we”, “us”, “our”). By using the Service, you agree to these terms.

1. The Service

Byrd is a web-based platform that helps choirs manage their members, music library, events, attendance, finances, and communications. We provide the platform as a software-as-a-service (SaaS) product hosted on Vercel infrastructure.

2. Accounts and access

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • Each choir organisation on Byrd is managed by its designated administrators, who control member access and data.
  • You must be at least 16 years old to create an account. Users under 18 must have parental or guardian consent, which the platform facilitates through its consent workflow.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious content, spam, or content that infringes third-party rights
  • Attempt to gain unauthorised access to other organisations' data
  • Use automated tools to scrape, crawl, or overload the Service
  • Resell access to the Service without our written permission

4. Data ownership and responsibility

  • Your data remains yours. Choir organisations retain full ownership of all data they enter into the platform (member records, financial data, music library, etc.).
  • We act as a data processor for choir member data. The choir organisation is the data controller and is responsible for having its own privacy policy, obtaining consent from members, and complying with applicable data protection laws.
  • We will not access, use, or share your organisation's data except as necessary to provide the Service, or as required by law.
  • On cancellation, you may request a full export of your data. We will delete your data within 90 days of account closure.

5. Pricing and payment

  • Byrd offers free and paid tiers. Features available on each tier are described on our pricing page.
  • Paid subscriptions are billed monthly or annually as selected at sign-up.
  • We may change pricing with 30 days' notice. Existing subscribers will be honoured at their current rate until the end of their billing period.
  • All prices are in GBP and inclusive of VAT where applicable.

6. Service availability

We aim to keep Byrd available 24/7 but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. Our infrastructure is hosted on Vercel with a PostgreSQL database on Neon, both with strong uptime track records.

7. Intellectual property

  • The Byrd platform, brand, design, and code are owned by us and protected by copyright.
  • Content you upload (music scores, documents, images) remains your intellectual property. You grant us a limited licence to store and serve this content solely to provide the Service.
  • MusicXML scores uploaded to the score player are stored privately and are only accessible to members of your organisation.

8. Limitation of liability

To the fullest extent permitted by law, Byrd is provided “as is” without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

9. Termination

  • You may cancel your account at any time. Free-tier accounts can simply stop using the Service.
  • We may suspend or terminate accounts that violate these terms, with notice where practical.
  • On termination, we will make your data available for export for 30 days, after which it will be deleted.

10. Changes to these terms

We may update these terms from time to time. We will notify registered users of material changes by email at least 30 days in advance. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of Scotland and the United Kingdom. Any disputes will be resolved in the courts of Scotland.
